California (CA)
CA is the headline non-uniform / deviation state — and the naming-rule outlier. Same framework as WA and NY; the deviations are what make CA special.
The regulator (stable)
Section titled “The regulator (stable)”- California Department of Insurance (CDI / CA DOI) — led by an elected Insurance Commissioner. STABLE
- Statute body: California Insurance Code + 10 CCR. STABLE
- Starting point: insurance.ca.gov
The headline deviation: agency-NAME pre-approval (grounded)
Section titled “The headline deviation: agency-NAME pre-approval (grounded)”California is the ONLY state that requires separate approval of an agency’s name before filing for licensing. This is grounded in the Fenwick guide and is the single most important CA-specific fact: GROUNDED · Fenwick
- The name must not mislead the public.
- It must clearly indicate the licensee is an insurance producer — generally must include the word “insurance” followed by a descriptor such as “agency,” “marketing,” “sales,” “solutions,” or “services.”
- It must NOT include restricted words/phrases like “Advisor” or “State.”
- Plan a CA-compliant name early (even if CA entry is only a future possibility) to avoid being forced to operate under a d/b/a.

CA structures its lines differently (verify the names)
Section titled “CA structures its lines differently (verify the names)”CA uses distinct license names rather than the generic NAIC bundles — e.g., Life-Only Agent, Accident & Health Agent, Property Broker-Agent, Casualty Broker-Agent, Personal Lines Broker-Agent. For the Glacis Tech E&O product, the relevant authority is the Casualty one. [STABLE that CA differs]

For the Glacis MGA in CA
Section titled “For the Glacis MGA in CA”- Do the name first. If the MGA entity might ever operate in CA, lock a CA-compliant name before forming the entity to avoid a d/b/a. GROUNDED · Fenwick
- Target the Casualty authority for Tech E&O.
- Confirm CA’s surplus-lines path (via the Surplus Line Association of California) — a novel AI Tech E&O risk is likely non-admitted. See 06 Surplus lines / E&S.
- CA is also a proactive AI-regulation state (Colorado is the named leader, but CA is active) — relevant to the compliance-as-a-feature story in 14 AI insurance regulation. VERIFY CA’s current AI bulletins.
